"content": "Regulation 2. Personal data may be transferred to a database abroad if: (a) the law of the receiving country provides a level of protection of personal data not lower than the level provided under Israeli law; (b) the data subject has consented to the transfer; (c) the transfer is made pursuant to a contract that ensures protection of privacy substantially equivalent to Israeli law; (d) the transfer is necessary for the performance of a contract to which the data subject is a party."

In determining whether a country provides adequate protection, the following factors shall be considered: (a) the nature of the data; (b) the purpose of the transfer; (c) the relevant laws and regulations of the receiving country; (d) the enforcement mechanisms in the receiving country; (e) the security measures applied to the data in the receiving country."

Where data is transferred on the basis of contractual safeguards, the contract shall include provisions ensuring: (a) the data will be used only for the purposes for which it was transferred; (b) the recipient will maintain the security of the data; (c) the data will not be further transferred without adequate protection; (d) the data subject's rights will be respected."
